6 At the time of Walsh's appointment, 17 August 1697, the Yukon was
still constituted a judicial district of the North West Territories
(P.C. 2640, approved 2 October 1895); hence it may be contended that
Walsh should not be designated the first commissioner of the Yukon
Territory per se. The Yukon became a separate territory only by the
provisions of the Yukon Act (61 Vic. cap. 6). 13 June 1898. It should be
noted, however (see text), that Walsh's commission specifically
conferred upon him the title "Commissioner of the Yukon Territory." For
the sake of continuity and symmetry in the text therefore, this
constitutional fine point has been overlooked, but is drawn to the
notice of the reader here.
